Intellectual Property for Non-Academic Employees

I. Purpose

The purpose of this policy is to assure parity among employees of the College.

Intellectual property rights are defined for academic employees in the collective bargaining agreement between the College and the Olympic College Association for Higher Education.

The following parallel rights are established for all other Olympic College Employees.

II. Intellectual Property Rights of Non-Academic Employees

  1. The ownership of any materials, processes or inventions developed solely by a non-academic employee’s individual effort and expense shall vest in the employee and be copyrighted or patented, if at all, in the employee’s name.
  2. The ownership of materials, processes or inventions produced solely for the College and at College expense shall vest in the College and be copyrighted or patented, if at all, in its name.
  3. In those instances where materials, processes or inventions are produced by a non-academic employee with use of significant College resources (personnel, time, facilities, or other) the ownership of the materials, processes or inventions shall vest in (and be copyrighted or patented by, if at all) the person designated (by written agreement) between the parties entered into prior to the production.
  4. In the event there is no prior written agreement entered into, the ownership shall vest in the College.
